Insights into the Department of Justice’s Response to Medicaid Work Requirements

A recent blog in Health Affairs by Sara Rosenbaum, the Harold and Jane Hirsh Professor of Health Law and Policy at the George Washington University Milken Institute School of Public Health, provides expert commentary on the Department of Justice’s brief responding to the Stewart v Azar lawsuit. The lawsuit challenges the legality of the Trump administration’s approval of Kentucky’s Medicaid 1115 work demonstration.

“The case turns on whether the HHS secretary’s actions exceed the authority granted him under Section 1115, a demonstration statute,” Rosenbaum writes in Stewart v Azar: Unpacking the Administration’s Motion to Dismiss and Governor Matt Bevin’s Assist. As the title suggests, the blog discusses an additional brief filed by Kentucky governor Matt Bevin as well as the one filed by the Department of Justice.
